Terms & Conditions

Definition

Client: Refers to any individual or business entity that engages BeVisual for digital marketing services.
Services: Refers to digital marketing, web design, social media management, public relations, and other related services offered by BeVisual.
Agreement: Refers to the agreement between BeVisual and the Client, which includes these Terms and Conditions, any proposal, scope of work, or invoice provided.

Services Provided

BeVisual provides a range of digital marketing services, including but not limited to:

1. Social Media Marketing
2. Web Design and Development
3. Search Engine Optimization (SEO)
4. Public Relations
5. Content Creation
6. Email Marketing
7. Marketing Strategy Consultation

A detailed scope of services will be provided in a proposal or contract based on the Client's needs.

Client Responsibilities

The Client agrees to:

  • Provide all necessary information, materials, and feedback required to complete the agreed-upon services promptly.

  • Ensure the accuracy and legality of any content provided to BeVisual for use in marketing campaigns.

  • Abide by any third-party platform terms and conditions that may be relevant (e.g., Facebook, Google, LinkedIn).

Fees and Payment

  • All fees will be clearly outlined in the proposal or invoice provided to the Client.

  • Payment is required according to the payment terms specified in the proposal or invoice.

  • Any additional services requested outside of the agreed scope of work will incur extra fees, which will be communicated in advance.

  • Late payments will be subject to a 5% late fee after 30 days of the due date.

Confidentiality

Both parties agree to maintain the confidentiality of any proprietary information shared during the course of the agreement. Neither party will disclose such information to third parties without prior written consent unless required by law.

Intellectual Property

  • BeVisual retains ownership of any intellectual property, including marketing strategies, designs, and content created during the project, until payment has been made in full.

  • Once payment is received, the Client will be granted a license to use the final deliverables for their intended purpose, as outlined in the agreement.

  • The Client grants BeVisual the right to use their company name and logo for promotional purposes unless explicitly prohibited.

Termination

  • Either party may terminate this agreement with 30 days' written notice.

  • If the Client terminates the agreement before the completion of the services, the Client will be liable for payment of services rendered up to the date of termination.

  • BeVisual reserves the right to terminate the agreement immediately in the event of non-payment, violation of these terms, or illegal activity by the Client.

Refund Policy

Refunds will be issued at BeVisual’s discretion, based on the services completed and any unfulfilled deliverables. Generally, payments for services already rendered are non-refundable.

Limitation of Liability

  • BeVisual will not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to, loss of data, revenue, or profit.

  • BeVisual’s total liability for any claim related to the services provided will be limited to the amount paid by the Client for those services.

Force Majeure

Neither party shall be liable for delays or failure to perform any obligation under this agreement due to events beyond their reasonable control, including but not limited to, natural disasters, pandemics, strikes, or government regulations.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Mauritius. Any disputes arising out of or related to this agreement shall be resolved through mediation or arbitration in Mauritius, unless otherwise agreed by both parties.

Changes to Terms

  • BeVisual reserves the right to update or modify these Terms and Conditions at any time. Clients will be notified of any significant changes, and continued use of our services after such changes constitutes acceptance of the new terms.
